The multidistrict litigation is In re Chantix (Varenicline) Marketing, Sales Practices and Products Liability Litigation (No. II), pending in the Southern District of New York. Plaintiffs alleged that Pfizer manufactured and sold branded Chantix containing an undisclosed nitrosamine. Pfizer denies wrongdoing and maintains that it did not violate the law.
The settlement creates a $44 million fund for consumers and third-party payors, along with notice and administration costs, attorneys fees, litigation costs, and class representative awards as approved by the court.
Consumers are paid pro rata based on out-of-pocket amounts, subject to a cap of 20% of the available settlement fund. The rest of the fund is distributed to third-party payors based on documented qualifying payments. The final approval hearing is scheduled for October 13, 2026.
