Denny's New York Unpaid Wages Settlement is a New York Attorney General enforcement case — not a private class action — with a $440,000 restitution fund. It covers workers at 23 Denny's franchise restaurants operated by Top Line Restaurants and/or Reveille Management in New York who missed spread-of-hours pay on workdays longer than 10 hours between January 1, 2019 and April 30, 2026. Eligible regardless of immigration status. Amounts are individualized from payroll records, not a flat per-worker figure. Deadline: October 31, 2026.

What Happened?

The New York Attorney General alleged that Top Line Restaurants and Reveille Management failed to pay the extra hour of minimum-wage spread of hours pay on workdays lasting more than 10 hours at 23 Denny's franchise restaurants in New York. This is an AG enforcement settlement, not a private class action.

The companies agreed to a $440,000 restitution fund. OAG reviewed payroll and time records to calculate an individualized amount per worker. The companies separately cover up to $40,000 in administration costs.

Certain New York child-support obligations may offset a payment. Filing is free.
