Grubhub, the food delivery platform, was sued for misclassifying its delivery drivers as independent contractors instead of employees under California law. California's AB5 law — one of the strictest gig worker protection laws in the country — established strict standards for classifying workers as independent contractors. The lawsuit alleged that Grubhub's delivery drivers met the legal definition of employees and were therefore entitled to benefits, expense reimbursements, and protections that Grubhub denied them.
As a result of the misclassification, drivers were not reimbursed for vehicle expenses, mileage, phone costs, and other work-related expenses that California employers are legally required to cover for employees. Approximately 62,000 Grubhub drivers in California are covered by the $24.75 million settlement.
How Much Will I Actually Get?
Your payment is calculated based on the estimated number of miles you drove while making Grubhub deliveries in California, as determined by Grubhub's own records. Drivers who completed more deliveries and drove more miles will receive larger payments. No documentation is required from you — Grubhub provides the mileage data.
