What Happened?
The Illinois Attorney General brought enforcement action against Hearthside Food Solutions alleging unlawful employment of workers under age 16 at Illinois facilities. The settlement creates a $4,500,000 fund to address those child labor claims.
Up to $2,250,000 (50% of the settlement fund) is allocated to claimant payments. Eligible workers — including direct-hire employees and staffing-agency temps — may claim a pro rata share based on weeks worked while under 16 during the March 1, 2020 through December 4, 2024 class period.
Payment formula: (50% of settlement fund ÷ total weeks worked by all claimants) × the claimant's own weeks worked while a minor. Exact amounts depend on total valid claims and weeks claimed. Immigration status does not affect eligibility.
Claims must be filed by November 20, 2026. Payments are expected in Q1 2027 after administrator review and court-approved distribution. File only through the official Atticus Administration portal at hearthsidefssettlement.com.
