Hospital Español Auxilio Mutuo de Puerto Rico is settling a class action over a September 2023 cyberattack that may have exposed the personal and health information of about 41,000 current and former patients. Class members can claim either a flat $25 cash payment or up to $2,500 in documented losses — not both — and everyone who stays in the settlement automatically qualifies for two years of credit and medical monitoring, no claim form required for that part. The $500,000 cap applies only to the cash payments, not to monitoring or legal fees. Deadline: December 21, 2026.

Do I Qualify?

You may be eligible if:

The $25 Alternative Cash Payment needs no documentation. A documented Out-of-Pocket Losses claim up to $2,500 needs receipts or other third-party records of an actual, unreimbursed loss more likely than not caused by the breach; self-prepared documents like handwritten receipts are not sufficient on their own. Online claims need the Class Member ID from the mailed notice. Credit and medical monitoring need only the enrollment code from the notice — no claim form.

File your claim through the official settlement website at hospitalespanolauxiliosettlement.com before December 21, 2026.

What Happened?

On or around September 2023, Hospital Español Auxilio Mutuo de Puerto Rico was targeted by a cybercriminal group, and an investigation found unauthorized access may have compromised patients' personal and health information, including Social Security numbers, financial account information and medical records. The hospital began notifying potentially affected people around April 21, 2025.

The case is Morales Rosario v. Hospital Español Auxilio Mutuo de Puerto Rico, Inc., No. 3:25-cv-01244, in the U.S. District Court for the District of Puerto Rico. The court granted preliminary approval on August 24, 2026; a final approval hearing is set for January 20, 2027. The hospital denies all wrongdoing.

How to File Your Claim

  1. File a Claim Form online at HospitalEspanolAuxilioSettlement.com using the Class Member ID from your mailed notice, or mail the paper claim form (postmarked by the deadline) to Kroll Settlement Administration, the court-appointed administrator
  2. Choose either the $25 flat payment (no documentation) or up to $2,500 for documented losses (receipts/third-party proof required)
  3. Deadline to file online or postmark a mailed claim: December 21, 2026
  4. Credit and medical monitoring do NOT require a claim form — enroll separately with the code in your mailed notice once the settlement gets final approval.
  5. Visit the official claim form: https://hospitalespanolauxiliosettlement.com/

How Much Will I Actually Get?

Class members choose either (1) an Alternative Cash Payment of $25 with no documentation, or (2) compensation for documented Out-of-Pocket Losses of up to $2,500 (losses must have occurred between September 2023 and December 21, 2026, and be backed by receipts or other third-party documentation — self-prepared records like handwritten receipts are not enough by themselves). You may claim one or the other, not both. These cash payments share a $500,000 total cap and may be reduced pro rata if claims exceed it. IMPORTANT: that $500,000 cap applies ONLY to the two cash options — it does NOT include the credit/medical monitoring benefit, attorneys' fees, notice and administration costs, or service awards, which the hospital pays separately. Separately from either cash choice, every class member who does not opt out automatically qualifies for two years of one-bureau credit monitoring and medical monitoring (at least $1 million in fraud protection, through CyEx) — no claim form is needed for monitoring, just the enrollment code in your mailed notice, active after final approval.

Frequently Asked Questions

How much is the Auxilio Mutuo Hospital settlement payment?
You can choose either a flat $25 cash payment with no documentation, or up to $2,500 for documented, unreimbursed losses caused by the breach — not both. Cash payments share a $500,000 total cap and can be reduced pro rata if claims exceed it.
Does the $500,000 cap limit my credit monitoring too?
No. The $500,000 cap applies only to the two cash payment options. The two years of credit and medical monitoring, plus attorneys' fees, notice costs and service awards, are paid separately by the hospital and are not reduced by that cap.
Do I need to file a claim to get credit monitoring?
No. Every class member who does not opt out is automatically eligible for two years of credit and medical monitoring through CyEx. You just need the enrollment code from your mailed notice once the settlement receives final approval — no claim form required.
What proof do I need to file a claim?
The $25 payment needs no documentation. A documented-loss claim up to $2,500 needs receipts or other third-party records; handwritten or self-prepared documents alone are not enough. Online claims also need the Class Member ID from your notice.
What is the deadline to file an Auxilio Mutuo settlement claim?
Claims must be submitted online by 11:59 p.m. on December 21, 2026, or mailed and postmarked by that date.
