Do I Qualify?

You may be eligible if:

• You are or were a patient of Boone Health, Inc. d/b/a Boone Health — the Columbia, Missouri health system also sued as CH Allied Services, Inc. d/b/a Boone Health and Boone Hospital Center
• You reside in Missouri. Missouri residency is written into the class definition, and this settlement has no nationwide component whatsoever
• You logged into the Boone Health Patient Portal between April 1, 2021 and December 5, 2022. THIS IS THE CONDITION THAT EXCLUDES MOST PEOPLE: visiting or browsing Boone Health's public website is not enough, even though the lawsuit is about tracking on that public website, and being a Boone Health patient who never signed in to the portal is not enough either
• You were sent a Notice by email or mail carrying a Settlement Class Member Login ID and Password — that Notice is the practical sign that Boone Health's records place you in the class, and the credentials are what the online claim form checks. If you believe you belong but never received them, email boonehealthsettlement@atticusadmin.com to verify your identity and be issued them
• You are not in an excluded group: the Judge assigned to evaluate the fairness of the Settlement, Court personnel and their immediate families, and Boone Health along with any entity it controls, parents, subsidiaries, affiliates, legal representatives, attorneys, heirs, predecessors, successors and assigns are all outside the class

Documents: none. The Claim Form asks for no receipts, no medical records, no portal screenshots and nothing showing a loss. It collects your first and last name, street address, city, state, ZIP code, email address, an optional digital payment election, and your signature and date. Signing is an affirmation, made to the best of your knowledge, that you are a natural person who is or was a Boone Health patient, resided in Missouri, and logged into the Boone Health Patient Portal between April 1, 2021 and December 5, 2022. Credentials: yes, to file online. This is why the settlement counts as proof-required even with an empty document list. The online claim form opens only after you enter the Settlement Class Member Login ID and Settlement Class Member Password printed on the Notice that was sent to class members by email or mail. Someone who never received that Notice, or deleted or discarded it, cannot get into the online form. The fix is official, not a workaround. Question 7 of the Notice directs anyone who did not receive the credentials but believes they are a class member to email boonehealthsettlement@atticusadmin.com to verify their identity and receive a Login ID and Password. A paper Claim Form is the other route — download it from the Court Documents page of the settlement website or call 1-800-936-3163 to request one — and it must be postmarked and mailed by November 9, 2026, while the online form has to be in by 11:59 p.m. PST that same day. Complete whichever form you use carefully: the Claims Administrator reviews claims for validity, and the Notice describes payment as going only to class members whose claims were approved.

What Happened?

Two plaintiffs suing as John Doe and Janice Doe brought a class action against Boone Health, Inc. d/b/a Boone Health and CH Allied Services, Inc. d/b/a Boone Health and Boone Hospital Center, Case No. 22AC-CC07646, in the Circuit Court of Cole County, 19th Judicial Circuit, State of Missouri. The suit alleges that Boone Health's use of third-party website technologies on its public website was improper and resulted in the transmission of certain information to third parties. Boone Health firmly denies all of the claims and maintains that it did nothing wrong, agreeing to settle only to avoid the expense, burden and uncertainties of continuing litigation. The Settlement does not mean Boone Health did anything wrong, and no court has found that it did.

There is a gap between what the case is about and who the settlement actually covers, and it is worth understanding before you assume you qualify. Question 3 of the court-authorized Notice frames the allegations around tracking technologies on the <strong>public website</strong>. The Settlement Class the Court approved, at Question 5, is narrower: patients of Boone Health who reside in Missouri and who <strong>logged into the Boone Health Patient Portal</strong> between April 1, 2021 and December 5, 2022. Someone whose information was allegedly swept up while reading Boone Health's public pages, but who never signed in to the portal, falls outside the class as written.

How Much Will I Actually Get?

THE TWO BENEFITS STACK — THIS IS NOT AN EITHER-OR SETTLEMENT. The court-authorized Notice says it in so many words on its rights-and-options page: under SIGN UP FOR PRIVACY SHIELD it reads “This is the only way to enroll in Privacy Shield. You can do this in addition to submitting a Claim Form for a Cash Payment.” Taking the money does not cost you the privacy product and enrolling in the privacy product does not cost you the money. CASH — $20.00 FLAT. Question 7 of the Notice states that if you submit a valid Claim Form and elect the cash, you will receive $20.00. It is a set figure per approved claim, not a slice of a pool, so it does not shrink as more people file. Boone Health has agreed to pay all Approved Claims. PRIVACY SHIELD PRO — SEPARATE, AND NOT ON THE CLAIM FORM. The Claim Form itself contains no box for the privacy product; it collects your name, contact details, payment method and signature for the $20 and nothing else. Enrollment runs on its own track. BE AWARE THAT THE OFFICIAL DOCUMENTS DO NOT AGREE ON HOW THE CODE REACHES YOU: Question 6 of the Notice says each Settlement Class Member “will automatically receive a code to enroll in Privacy Shield Pro” and that “the code is listed at the top of your Notice,” while the summary box on the first page of the same Notice says you will “receive a separate email with instructions.” Check the top of your Notice first, then watch your email, and call 1-800-936-3163 if neither turns up a code. THERE IS NO SETTLEMENT FUND FIGURE AT ALL, AND THE ONE BIG DOLLAR NUMBER IN THIS CASE IS NOT YOURS. The largest amount anywhere in these documents is $800,000 — and that is the ceiling on what Class Counsel may ASK the Court to award in attorneys' fees, costs and expenses, not a class fund and not a total settlement value. Question 13 of the Notice says those fees are “paid separately by Defendant.” The same is true of the service awards: the two Class Representatives may seek up to $2,000.00 each, $4,000.00 in total, and Boone Health pays those separately too, as it does the Notice and Administration Expenses. Not one cent of the $800,000 or the $4,000 is deducted from anybody's $20, and the Court may award less than either figure. TIMING AND RISK. Nothing is paid until the Court grants final approval. The Final Approval Hearing is set for December 1, 2026 at 8:30 a.m. at the Cole County Courthouse, Division Three, 301 East High Street, Jefferson City, Missouri, and the Notice warns the hearing may be postponed without further notice. Question 8 states that approved claimants are paid 60 days after the Settlement has been finally approved and any appeals process is complete — so payment is realistically well into 2027.
