Plaintiffs in Branson & Phillips v. Concord Hospital Inc. et al., Case No. 217-2024-CV-00295 (Hillsborough Superior Court, Manchester, New Hampshire), allege Concord violated the New Hampshire Wiretapping and Electronic Surveillance Act and the New Hampshire Patient Privacy Law by placing third-party tracking technology — including website pixels such as Google Analytics and Geonetric — on Concord Web Properties.
Plaintiffs claim those tools may have intercepted visitors' telecommunications and disclosed protected health information to third parties. Concord denies wrongdoing. The settlement is a compromise to end the litigation.
Concord will fund an $800,000 common fund. After attorneys' fees (up to 33.33%), litigation costs, service awards, and administration costs, remaining funds are paid pro rata to valid claimants.
The Final Approval Hearing is November 3, 2026 at 9:00 a.m. Payments are expected within about 90 days after final approval and resolution of any appeals.
