Deanco Healthcare, LLC, which operates Mission Community Hospital in Panorama City, California, has agreed to a $1,546,409.42 class action settlement to resolve claims arising from a 2023 cybersecurity attack on its IT network. On May 1, 2023, a threat actor gained unauthorized access to Deanco's computer systems and compromised database files containing personal and health information belonging to current and former patients. Deanco conducted an investigation and, after determining the scope of the exposure, notified affected individuals on or around November 21, 2023 — approximately six months after the attack. The delay between the breach and notification became one of the points of dispute in the subsequent litigation.
The class action, Concepcion, et al. v. Deanco Healthcare, LLC d/b/a Mission Community Hospital, Case No. 23STCV29292, was filed in the Superior Court of California, County of Los Angeles, before the Honorable David S. Cunningham III. Plaintiffs alleged that Deanco was negligent in its data security practices, breached obligations owed to patients whose information it held, and failed to timely detect and disclose the intrusion. The data at risk reportedly included names and addresses, dates of birth, Social Security numbers, driver's license numbers, financial account information, health insurance plan member IDs, claims data, and clinical information about care at Mission Community Hospital. Deanco denies all allegations and has not admitted wrongdoing; the settlement is a compromise to avoid the cost, risk, and delay of continued litigation and is not a finding of liability. The $1,546,409.42 settlement fund covers benefits to class members, notice and administration expenses (capped at $235,400), court-approved service awards to the named plaintiffs, and attorneys' fees and costs. How Much Will I Actually Get?
All class members may enroll in two years of CyEx Medical Shield Complete monitoring services at no cost, regardless of which cash option they select. CyEx Medical Shield Complete includes single-bureau credit monitoring, health insurance and medical ID monitoring, dark-web surveillance, and $1,000,000 of identity-theft insurance. A fraud resolution agent is available to assist if monitoring detects suspicious activity. This benefit is available to all class members and does not require any documentation or proof of losses.
Beyond the monitoring benefit, class members may choose from three cash options funded by the $1,546,409.42 settlement fund. First, class members who incurred documented out-of-pocket losses traceable to the breach — such as unauthorized charges, credit monitoring fees, costs to replace government-issued documents, or professional costs to address identity fraud — may claim reimbursement of up to $5,000 with supporting documentation such as bank statements, receipts, or invoices. Second, eligible California class members may claim a $100 California statutory payment instead of the documented loss benefit. Third, all class members are eligible for a pro rata residual cash payment — an equal share of whatever money remains in the fund after documented loss payments, California statutory payments, administration expenses, and attorneys' fees and costs are deducted. The exact residual payment amount cannot be calculated until after the claims deadline and will depend on the total number and type of claims filed.
