Lily Transportation Washington Job Postings Settlement is a Washington Equal Pay and Opportunities Act case with a fund of $317,760 to $456,000. People who applied for a Lily Transportation job opening in Washington between January 1, 2023 and December 10, 2025 where the posting omitted a wage scale or salary range may receive an equal share, estimated at a minimum of $606.31 and capped at $5,000 per person. Read this before you file: the class is small and closed — about 456 people — and Lily Transportation's own application records decide who is in it. Filing online requires the LoginID and PIN from a personalized notice that was mailed and emailed to class members. If no notice reached you, you are not on the list, and getting added means disputing your omission with documents within 60 days of the notice mailing. Claim deadline: November 23, 2026. File at EPOASettlementLT.com.

What Happened?

Joshua McClelland and Harold Allen Peery sued Lily Transportation, LLC and Lily Transportation Corp. in Thurston County Superior Court (Case No. 24-2-01635-34), alleging the companies posted Washington job openings without the wage scale or salary range required by Washington's pay transparency law, RCW 49.58.110. Lily Transportation denies the allegations and denies any liability, and the court has not decided whether the company broke the law.

Judge Christine Schaller preliminarily approved the settlement on August 8, 2026 and authorized Simpluris, Inc. to send notice. The settlement creates a fund of at least $317,760 and at most $456,000. Each claimant receives an equal share of the net fund, estimated at a minimum of $606.31, with a $5,000 ceiling on any single payment; amounts above that ceiling go to the Legal Foundation of Washington rather than to other claimants.

This is a narrow, records-based class of roughly 456 people, not an open call for anyone who ever applied to Lily Transportation. Membership is set by the company's own application records, and the online claim portal requires the LoginID and PIN from a personalized notice. Someone who believes they were left off the class list has 60 days from the notice mailing to raise it with the administrator and must back it up with documents; Lily Transportation's records control, and the administrator is the final arbiter.

The claim, opt-out, and objection deadline is November 23, 2026. The final approval hearing is set for February 26, 2027 at 9:00 a.m. before Judge Schaller, with a remote option posted on the settlement website. No money is paid unless the court grants final approval; Lily Transportation then funds the settlement within 45 days of the effective date and the administrator mails checks within 14 days after that. Checks expire 120 days after issuance, and uncashed funds go to Washington's unclaimed property program in the class member's name.

How Much Will I Actually Get?

Every class member who files a timely, valid Claim Form receives an equal share of the net settlement fund. The notice puts the estimated minimum payment at $606.31, and the settlement caps each individual payment at $5,000. That $5,000 is a per-person cap, not a cap on the settlement as a whole: the fund itself runs from a $317,760 minimum to a $456,000 maximum. The per-person figure moves the opposite way from most settlements — Lily Transportation pays the $317,760 minimum if 228 or fewer people file, so the fewer people who claim, the larger each share. For every claimant beyond 228 the net fund grows by $603.31, holding each share near $606 until the $456,000 maximum is reached. Anything that would push one person above $5,000 is not redistributed to other claimants — it goes to the Legal Foundation of Washington. The maximum fund also has to cover requested attorneys' fees of $134,520, up to $15,000 in litigation costs, $15,000 in service awards for the two class representatives, and up to $15,000 in administration costs, all subject to court approval. Payments are treated as non-wage statutory damages and reported on IRS Form 1099-MISC, and checks become void 120 days after they are issued.

Frequently Asked Questions

Who qualifies for the Lily Transportation settlement?
People who applied for a job opening in Washington with Lily Transportation, LLC or Lily Transportation Corp. between Jan. 1, 2023 and Dec. 10, 2025, where the posting did not disclose a wage scale or salary range.
I applied to a Lily Transportation job in Washington but never got a notice. Can I still claim?
Probably not. The class is a closed list of about 456 people built from Lily Transportation's own application records, and the notice carries the LoginID and PIN needed to file online. If you were left off, you have 60 days from the date notice was mailed to raise it with the settlement administrator, and you need documents to support it — the company's records control, and the administrator is the final arbiter of those disputes.
How much will I receive?
An equal share of the net fund. The notice estimates a minimum of $606.31, and no single payment can exceed $5,000.
Does the $5,000 cap apply to the whole settlement?
No. The $5,000 is a per-person ceiling on an individual payment. The settlement fund itself ranges from $317,760 to $456,000. Any amount that would push one person past $5,000 is sent to the Legal Foundation of Washington instead of being split among other claimants.
Why would my payment be more than $606?
Because the fund has a floor. Lily Transportation pays at least $317,760 even if only a handful of the roughly 456 class members file, so each equal share grows as participation falls. Beyond 228 claimants the net fund rises by $603.31 per additional claimant, which keeps each share near $606 up to the $456,000 maximum.
When is the claim deadline?
Nov. 23, 2026, which is also the opt-out and objection deadline. A late Claim Form is paid only at Lily Transportation's discretion.
Is the payment taxable?
The settlement treats payments as non-wage statutory damages and the administrator issues an IRS Form 1099-MISC for each one. Checks become void 120 days after issuance, and uncashed money goes to Washington's unclaimed property program in your name.
