What Happened?

James Russell Norman and Cherie Burke sued Sizzling Platter, LLC in King County Superior Court in Washington, alleging that the company's Washington job postings did not disclose the wage scale or salary range, and/or did not provide a general description of the benefits or other compensation being offered, in violation of the job posting and pay transparency requirements of the Washington Equal Pay and Opportunities Act, RCW 49.58.110. Sizzling Platter disputes the claims, contends it has not violated any law and that the claims are without merit, and does not admit wrongdoing by settling. The court has made no determination on the merits and has not decided whether the company violated the law.

The case is James Russell Norman & Cherie Burke v. Sizzling Platter, LLC, Case No. 25-2-10677-2 SEA, before Judge Taki Flevaris in King County Superior Court, Washington. Ackermann & Tilajef, P.C. of Tacoma was appointed Class Counsel; Sizzling Platter is represented by Davis Wright Tremaine LLP and Seyfarth Shaw LLP, both of Seattle. The parties reached a proposed class action settlement under which Sizzling Platter pays a Minimum Settlement Fund of $634,472.50 and no more than a Maximum Settlement Fund of $937,650, with the figure in between driven by how many people actually file. On August 5, 2026 the court issued an order preliminarily approving the settlement and authorizing Simpluris to issue the Notice and Claim Form. Notices went out carrying a claim deadline of November 17, 2026.

This is one of a long run of Washington pay transparency cases brought under RCW 49.58.110 against employers whose job postings omitted pay ranges. It is a separate matter from the other Washington job posting settlements tracked on this site, which involve different companies, different class periods and different funds.

The Final Approval Hearing is scheduled for February 19, 2027 at 9:00 a.m. at King County Superior Court, 401 4th Ave. N, Room 2D, Kent, WA 98032. The official website warns that the date and time can change by court order. A scheduled hearing is not an approval: no final approval order has been entered, no payments have been issued and no payment date has been announced. If the settlement is approved and no appeal is filed, checks are mailed after all appeals and reviews are complete.

How Much Will I Actually Get?

THE $5,000 IS A PER-PERSON CEILING, NOT AN AMOUNT ANYONE EXPECTS TO RECEIVE. The realistic figure is the one on your Claim Form, and the Notice puts it at "at least $613.71." Every claimant receives an equal share of the Net Settlement Fund — there is one payment and one calculation, with no tiers and nothing to elect. Paragraph 16(b) of the Settlement Agreement allocates that share pro rata up to a maximum of $5,000 per Settlement Claimant, and any amount beyond $5,000 per claimant is paid out to the Legal Foundation of Washington as Residual Funds. So the $5,000 only bites if so few people file that an equal share would exceed it, and money displaced by the cap goes to a charity rather than to other claimants. THREE DIFFERENT CAPS APPLY TO THREE DIFFERENT PARTS OF THIS SETTLEMENT, AND NONE OF THEM CAPS THE WHOLE THING AT $5,000. The $5,000 limits what one claimant can be paid. The $937,650 Maximum Settlement Fund limits what Sizzling Platter can be made to pay in total. THE FUND GROWS WITH TURNOUT, WHICH IS THE OPPOSITE OF THE USUAL ARRANGEMENT. In most settlements a fixed pot means each additional claimant shrinks everyone's share. Here Sizzling Platter pays a floor of $634,472.50 (the Minimum Settlement Fund) as long as the number of claimants is at or below approximately 50 percent of the class, which the Settlement Agreement fixes at 493 people. For every claimant beyond that initial 493, the value of the Net Settlement Fund increases by $613.71, until the total reaches the $937,650 Maximum Settlement Fund. The effect is that heavy turnout holds each share near $613.71 instead of diluting it, while light turnout raises each share above $613.71 — subject to the $5,000 ceiling. WHAT COMES OUT BEFORE ANYONE IS PAID: Class Counsel will ask the court to approve attorneys' fees of $281,295 — roughly 30 percent of the Maximum Settlement Fund — plus costs and expenses, and service awards of $10,000 to each of the two Class Representatives, totalling $20,000. The court-authorized Notice and the official FAQ put the costs and expenses request at $10,000, while Paragraph 9 of the Settlement Agreement contemplated $15,000; the court decides the actual figure and may award less than is requested. Payments are characterized as non-wage statutory damages and reported on an IRS Form 1099-MISC, so this is not back pay. Checks are mailed only after final approval and any appeals are complete, and they expire and become void 121 days after the date of issuance. Money left in an uncashed check is sent to the Washington State Unclaimed Property Fund in the claimant's own name, so it is not forfeited to the company — but recovering it from the state is your problem, not the administrator's.
