Purchasers of MG217 coal tar shampoo products sued the manufacturer, Lake Consumer Products, Inc., alleging that Lake did not properly manufacture these products in accordance with current Good Manufacturing Practices (cGMPs) and industry practice as to the levels of benzene present in the Products.
Lake denies Plaintiff's claims, denies any fault or wrongdoing, and asserts that the Products are safe and conform with all state and federal regulations. The Court has not decided whether Lake did anything wrong. The parties agreed to a Proposed Settlement to avoid the expenses and uncertainties of continuing the lawsuit.
The case is Lorisa Pineda v. Lake Consumer Products, Inc., Case No. 5:2024-cv-01074-CH, before Judge Henry in the U.S. District Court for the Eastern District of Pennsylvania. The Final Approval Hearing is scheduled for October 15, 2026. Lake also agreed not to manufacture, market, distribute, or sell the Products unless coal tar in the finished product is no more than 0.5% by weight.

How Much Will I Actually Get?
No-proof claimants can choose either a cash payment of up to $7 per qualifying product OR a $25 product voucher for future MG217 purchases (vouchers do not expire, are transferable, and may be combined with other discounts). Claimants WITH proof of purchase can receive both a documented cash benefit (the purchase price for each qualifying purchase, subject to pro rata adjustment) and a voucher. The $1,200,000 settlement is a $700,000 non-reversionary cash fund plus a $500,000 non-reversionary voucher fund. Final per-claim amounts depend on total valid claims filed (pro rata).
