Duke University Health System embedded tracking pixels from Meta (Facebook) and other third-party companies into its MyChart patient portal and MyDuke Health mobile app. These invisible tracking tools collected sensitive health information — including appointment types, medical conditions implied by portal activity, and medication searches — and transmitted it to Facebook and other advertisers without patient consent.
This practice violated HIPAA, which prohibits healthcare providers from sharing patient health information with third parties without authorization. Duke agreed to pay $3.74 million to settle the class action brought by affected patients.
