What Happened?

On January 16, 2025, unauthorized actors accessed Marlboro-Chesterfield Pathology, P.C. systems. The lab publicly announced the breach on or around May 22, 2025, notifying approximately 235,000 current and former patients. Exposed information included names, addresses, dates of birth, medical information, health insurance information, and for some individuals, Social Security numbers.

The lawsuit is Cox v. Marlboro-Chesterfield Pathology, P.C., Case No. 25CV001289-620, pending in the Superior Court of North Carolina, County of Moore. Plaintiffs allege the pathology lab failed to properly secure sensitive patient data. MCP denies wrongdoing but agreed to settle.

The settlement received preliminary court approval on May 22, 2026. Class members may choose documented-loss reimbursement up to $1,000 or a $10 alternative cash payment limited to those whose SSN was compromised. How Much Will I Actually Get?

Class members may choose between two cash payment paths: (1) up to $1,000 for documented monetary losses arising from financial fraud or identity theft related to the data breach, with supporting documentation required; or (2) a $10 alternative cash payment available only to class members whose Social Security number was compromised in the Data Incident, in lieu of documented-loss compensation — you must choose one cash option, not both. All class members may also elect one year of 3-bureau credit monitoring (3B Credit Monitoring) with at least $1,000,000 in fraud protection regardless of which cash tier they select.
